Use of Objective Build by each participant in any building consent application(s) whether as Owner, Owner’s Agent or other party (now called “Participant”) is subject to the following conditions:

1. Lodgement via Objective Build does not in any way guarantee the Consenting Authority will approve an application.
2. Documentation and information held by the Consenting Authority will be subject to the Consenting Authority’s own privacy policy. Any personal information inputted to Objective Build will be subject to Objective’s Privacy Policy (available here: https://www.objective.com/privacy-policy).
3. Participants will:
   1. only use Objective Build in accordance with these Terms of Use and the Consenting Authority’s rules for use, if any, and only as permitted by applicable law;
   2. be responsible for their own technical, network and communications links to Objective Build and for the data that is uploaded;
   3. take reasonable care to protect logins and passwords from being compromised;
   4. ensure all data submitted is lawful and is not subject to any copyright or other lawful restriction,such as defamation, discrimination, threats, indecency and obscenity; and
   5. not:
      1. introduce a virus or other security vulnerability to Objective Build;
      2. attempt to circumvent any authentication or other security measures to access Objective Build;
      3. create derivative works of Objective Build;
      4. reverse engineer, reverse compile, decompile, disassemble, or otherwise attempt to derive the source code of Objective Build;
      5. intentionally, recklessly or negligently overload the processing capacity of Objective Build Environment in any way, including by introduction of a robot to flood the network or otherwise cause an effective denial-of-service or do any of the foregoing in respect of the Support Portal; or
      6. use Objective Build in any way that causes civil or criminal liability for Objective.
4. Participants acknowledge that in the event of any non-compliance these Terms of Use Objective may notify the Consenting Authority about the Participant’s conduct and the Consenting Authority may direct that the Participants access is suspended or restricted.
5. Objective may make third-party applications or services (each a “Third-Party Solution”) available to you via Objective Build. Objective has no responsibility or liability for your use of any Third-Party Solution, and any such use is solely a matter between you and the Third-Party Solution provider. If you do use a Third-Party Solution in relation to your use of Objective Build, you hereby consent to: (a) Objective sharing the data that you input to Objective Build (“Application Data”) with the applicable Third-Party Solution provider; and (b) the applicable Third-Party Solution provider receiving, storing and processing the Application Data in connection with your use of the Third-Party Solution.
6. Limitation of Liability.
   1. Objective’s liability to Participant for any and all claims arising out of or in relation to these Terms of Use and/or Participant’s use of Objective Build and/or any unavailability of Objective Build (whether arising in contract, tort (including negligence), statute, equity or otherwise) will be limited in aggregate to NZD 100.
   2. In no event will Objective be liable (whether arising in contract, tort (including negligence), statute, equity or otherwise) to Participant for any: (a) loss of or damage to revenue, profits, sales, business, data, goodwill, opportunity or anticipated savings; (b) consequential, indirect, exemplary, punitive, special, or incidental losses or damages; or (c) damage or injury to, or loss of, reputation; even if Objective has been advised of the possibility of such losses or damages.
7. Objective is the owner or authorised licensor of all intellectual property rights in and to Objective Build, and retains all rights not expressly granted to you in these Terms of Use.
